Dem DA in Texas wants death penalty for alleged Tren de Aragua gangsters in rape, murder of Jocelyn Nungaray

A Democratic Houston-area district attorney said she will seek the death penalty against the two reputed Tren de Aragua gangbangers accused of raping and murdering little Jocelyn Nungaray earlier this year — as she ripped her party’s policies on open borders.

Harris County DA Kim Ogg said that illegal immigrants Franklin Jose Peña Ramos, 26, and Johan Jose Rangel Martinez, 21, will face the ultimate sentence over the brutal June slaying of the Texas 12 year old, who was sexually assaulted, tortured and strangled in the attack.

“We’ll be filing notice by the state of Texas that we intend to seek the death penalty against Jocelyn’s murderers, Pena and Rangel. Both were Venezuelan nationals, they had been captured while committing a crime, coming into this country illegally, and then within days of murdering and raping Jocelyn Nungaray,” Ogg said on “Fox & Friends” Friday morning.

“So we are seeking death because we want the message out there that regardless of who you are, but especially if you are illegally in this country, that you will face the same consequences as anyone else for murdering a child during the course of raping and kidnapping her,” she added.

The two accused attacker crossed the southern border illegally and were released into the country just weeks before the sick attack on Jocelyn.

The two alleged killers, who are also believed to be members of the Venezuelan prison gang Tren de Aragua, are said to have tortured Jocelyn for hours as she fought back before they dumped her lifeless, half-naked body into a nearby creek.

During the murder, Pena Ramos was wearing his ICE ankle monitor, which he removed two days after Jocelyn’s body was found, Homeland Security sources previously told The Post.

The two illegal migrants were indicted on capital murder charges in September.

Jocelyn’s killing garnered national attention and her family has come out to call out the border policies of the Biden administration for allowing the alleged killers into the country in the first place.

Jocelyn’s mother, Alexis, appeared alongside President-elect Donald Trump while he was on the campaign trail in October.

“Kamala Harris has never reached out to me, just even as a human, to give her condolences as a humane person running this country,” she said.

“I think it’s very sad that she can’t even just give me an open apology, sincere apology,” the mom added.

Ogg said she spoke to Jocelyn’s family before making the decision to move forward with pursuing the death penalty against the young girl’s alleged killers, saying they’re supportive of the decision.

“We base these decisions on the strength of the evidence and the gruesomeness of this crime and yes I’ve spoken with Alexis Nungaray multiple times along with her father,” Ogg said.

“Their family is supportive of this move. We don’t make the victims choose, our prosecutors determines what’s most likely [to succeed]. But we feel that a Texas jury will sentence these two defendants based on the evidence we have to death,” she added.

The outgoing district attorney also took swipes at the “the Democratic policies of open borders,” saying they’ve “failed the American public.”

Ogg has supported legislation proposed by Senator Ted Cruz to ensure that illegal migrants remain in in federal custody, rather then get released into the US.

“If the Justice for Jocelyn Act filed by Senator Ted Cruz or any of the policies that President-elect Trump is pushing had been in effect, then it’s likely that Jocelyn Nungaray would be alive today. These types of horrific crimes committed by illegal immigrants crossing our border have to stop,” Ogg said. 

“The family of Jocelyn is in a position they never dreamed would happen to them, and I think it’s unfair for anybody with children to be subject to criminals committing horrific crimes that don’t have to happen. If these fellows hadn’t been in that country, Jocelyn would be alive.”

“Crime has no party, let’s get em.”
