Construction supervisor fined $30,000 for serious workplace injury

A man overseeing a Calgary construction site has been ordered to pay a $30,000 fine after pleading guilty to a safety violation that left a worker injured.

The incident occurred Dec. 10, 2021 when a worker on roof removed plywood covering an opening and fell through the space, plunging 4.5 metres, suffering serious injuries.

Supervisor Jeffrey Gross pleaded guilty to  failing to take all precautions necessary to protect the health and safety of a worker and was sentenced in Calgary Court of Justice on Sept. 24.

That penalty includes a 20 per cent victim fine surcharge and Gross and the Crown have 30 days to appeal the penalties or conviction.

Four other charges facing Gross under occupational health and safety (OHS) legislation were dropped.

A trial related to the same incident begins on Oct. 21 in the Calgary Court of Justice with employer and prime contractor Graham Construction and Engineering Inc. and Graham Construction and Engineering LP facing seven charges under OHS laws.  

That injury incident occurred on the same day one man died after it’s believed he inhaled toxic fumes while using paint and lacquer at a home construction site in the 1200 block of Cornerstone Way N.E.

Another worker was taken to hospital in life-threatening condition in an incident that was investigated by OHS.
