Despite evidence concluding last month, a Calgary youth charged in the murder of city teen Danillo Canales Glenn won’t learn is fate until the new year.
Student At Law Mackenzie McCaffrey appeared in Calgary Court of King’s Bench on Friday on behalf of defence counsel Alain Hepner to schedule a date for oral arguments in the case and Justice Eleanor Funk’s verdict.
McCaffrey told Justice Rosemary Nation the Crown and defence have agreed to make verbal submissions in the case on Dec. 16.
Funk will then hand down her decision on Jan. 10, she said.
Canales Glenn, 18, and two friends were shooting hoops the evening of Sept. 5, 2023, on the community’s outdoor rink pad when they were approached by two hooded males.
The group was pepper sprayed and while the two friends managed to flee the scene, Canales Glenn remained behind and was fatally stabbed.
It’s the Crown’s theory the accused, now 17, and his older brother, then 18, who also can’t be named to protect his younger sibling’s identity. jumped over the boards into the arena area and attacked Canales Glenn, stabbing him in the heart.
Evidence before Funk concluded on June 27, but at Hepner’s request the Court of King’s Bench judge agreed to receive written submissions on the case before oral submissions are heard.
Among the crucial pieces of evidence in the case is a black Nike shoe the prosecution says was left at the scene by the younger brother.
The footwear contains Hepner’s client’s DNA.
Prosecutors Vicki Faulkner and Jo-Ann Munn Gafuik also introduced CCTV camera footage from multiple homes which they say shows the brothers fleeing the scene on bicycle.
