Youth charged with murder was co-operative with police when he was arrested, court hears

‘He just stood there compliant. He didn’t say much’

The Calgary youth charged in the fatal stabbing of a city teen was “quiet and compliant” when arrested for murder, court heard Wednesday.

Const. Jake Primeau testified he was one of four officers sent to a residence in the Copperfield community in southeast Calgary to charge the then-16-year-old and his older brother.

Primeau told Crown prosecutor Vicki Faulkner that another family member answered the door and indicated the brothers were present in the home.

The two accused then voluntarily came out of the house, he said.

“I was authorized to arrest them for murder by (homicide) Det. (Scott) Guterson,” Primeau told the youth’s Calgary Court of King’s Bench trial.

“I arrested (the youth),” he said, of the incident last Sept. 9.

“He was quiet and compliant with our directions,” the officer said.

Primeau read the accused his Charter rights and the teen did not appear to have any difficulty understanding what he was being told.

The youth was then taken to Westwinds police headquarters in northeast Calgary.

He’s charged with second-degree murder in the fatal stabbing last Sept. 5 of Danillo Canales Glenn, 18, who was shooting baskets with two friends at the outdoor rink in Copperfield in the early evening when two males with hoods pulled over their heads approached.

The group was pepper sprayed, and while Canales Glenn’s two friends fled the area, the victim “stood his ground” and was fatally stabbed in the heart.

The youth’s brother is also charged with second-degree murder, but his case is proceeding separately in adult court.

Primeau testified the accused was photographed at police headquarters.

He remained “quiet, really didn’t show much emotion,” the witness said.

“He just stood there compliant. He didn’t say much.”

Meanwhile, Justice Eleanor Funk was shown a series of closed-circuit television clips seized from various residences in the area, both from before and after the attack on Canales Glenn.

The videos apparently capture the two brothers biking in the direction of the Copperfield/Mahogany Community Centre where the rink was located shortly after 7:30 p.m., before riding in the opposite direction a few minutes later.

Det. John Pearson, who seized the videos from multiple residences, played one clip showing an individual in a dark hoody and grey pants riding a bike with only one shoe on.

A witness earlier identified a still photo of the shoeless individual as the accused.

Police seized a black Nike runner found in the middle of the rink after the attack on Canales Glenn, which contained matches to the accused’s DNA on three locations.

The Crown is expected to close its case on Thursday.
