Doctors need more time to determine if suspect in landlord killing qualifies for not criminally responsible defence

The suspect in the fatal stabbing of a Calgary landlord needs more testing to determine if he meets the criteria for a not criminally responsible defence by reason of a mental disorder.

Defence counsel Allan Fay told Justice Gordon Putnam doctors at the Southern Alberta Forensic Psychiatry Centre need more time to complete their assessment on murder suspect Ryan Kinoshita.

Fay asked Kinoshita’s case be adjourned to Aug. 2, to allow doctors more time to determine the accused’s mental condition at the time Joel Aaron Clark’s killing in April.

“As a result of reviewing disclosure and speaking with my client I have a significant concern regarding Mr. Kinoshta’s mental state at the time of the homicide and before that,” the lawyer said during the June 3 proceedings before Justice Catherine Skene.

“I’m asking that he be sent to SAFPC for him to be assessed to see if he meets a section 16 criteria,” Fay said.

The lawyer told court his client was consenting to the application.

Kinoshita, 29, is charged with second-degree murder in the April 8, fatal stabbing of Clark, who was his landlord at their southeast Calgary residence.

Police said Clark, 46, was fatally stabbed inside the home he owned on Prestwick Terrace S.E.

If determined to have been suffering a mental disorder which rendered him incapable of appreciating the nature and quality of his conduct at the time, Kinoshita would be dealt with means other than through the criminal justice system.

He would in all likelihood be ordered to appear before the Alberta Review Board which would determine his next steps.

Kinoshita remains in custody pending a resolution to the case.
